The bankruptcy fees are current as of January, 2010. Fees may be subject to change and will be announced by the U.S. Bankruptcy Court.

The fees listed below are statutory bankruptcy filing fees, payable to the bankruptcy court. These figures may have changed since our last update and DO NOT include bankruptcy attorney fees, which vary depending upon attorney, the complexity of your case and a variety of other factors.

  • Chapter 7: $299.00
  • Chapter 11: $1,039.00
  • Chapter 12: $239.00
  • Chapter 13: $274.00

Credit Counseling: The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 launched a new era: With limited exceptions, people who plan to file for bankruptcy protection must get credit counseling from a government-approved organization within 180 days before they file. They also must complete a debtor education course to have their debts discharged. Many providers usually charge around $50 for every counseling session. In some cases, the fees can be waived for clients who are unable to pay according to the Bankruptcy Act's guidelines.
