Fees and Costs For an Eviction
The fees listed below, except for the process server and sheriff's department, are statutory filing fees, payable to the court. These figures may have changed since our last update and DO NOT include attorney fees, which vary depending upon attorney, the complexity of your case and a variety of other factors.
Superior Court Filing Fees (Effective October 22, 2010)
- Complaint with amount in controversy over $25,000: $395.00
- Complaint with amount in controversy over $10,000 and up to $25,000: $385.00
- Complaint with amount in controversy up to $10,000: $240.00
- Motion or other paper requiring a hearing: $40.00
- Ex parte application: $40.00
- Request for order authorizing service of summons by posting or by publication: $20.00
- Issuing writ of possession: $25.00
Process Server Fees
- Fees generally range from $75.00-$175.00.
The amount of the fee is based on the location of the subject property and the number of attempts it takes to locate and effectuate service on the tenant. A process server is generally used at least twice in the process. The first serve is the notice to quit. The second serve is the complaint and summons. Total fees for process server for both serves generally range between $150.00-$350.00.
Sonoma County Sheriff's Office Fees
- Fee for eviction: $125.00
